Apple has recently filed a lawsuit against one of its former employees, Andrew Aude, for leaking confidential information to journalists and employees of other companies. The lawsuit, which was filed in California state court, alleges that Aude disclosed unknown details about Apple’s Journal app, the development of the VisionOS headset, regulatory compliance strategies, employee headcounts, and other product hardware characteristics.
Details of the Allegations
According to Apple, Aude connected with a Wall Street Journal journalist over 1,400 times using an encrypted messaging app. He also shared a final feature list for an unannounced Apple product over the phone with the same reporter. Additionally, Aude sent over 10,000 text messages to another journalist at The Information and even traveled across the continent to meet with her.
Aude joined Apple in 2016 as an iOS engineer focused on optimizing battery performance. Due to the nature of his role, he had access to sensitive information about dozens of Apple’s most important products. The leaks did not come to light until late 2023, and Aude initially denied his involvement when confronted by Apple representatives.
Deceptive Actions
Apple claims that during a meeting with Aude in November 2023, he lied about having his Apple-issued iPhone with him. Later, he allegedly faked needing to use the bathroom and deleted evidence from his phone, including the Signal app. In a subsequent meeting in December, Aude admitted to leaking information about Apple’s strategies for regulatory compliance, unannounced products, development policies, and hardware characteristics.
As a result of Aude’s actions, Apple terminated his employment. The company is now seeking a jury trial, damages, restitution and/or disgorgement of bonuses and stock options, as well as an order directing Aude to comply with Apple’s demands.
Overall, this case underscores the importance of maintaining confidentiality and trust within a company, especially when dealing with sensitive information. It also serves as a cautionary tale for employees who may be tempted to leak proprietary information for personal gain or to undermine the company they work for. Apple’s swift and decisive action in response to Aude’s actions demonstrates the company’s commitment to protecting its intellectual property and ensuring the security of its products and technologies.
